By using HULA you agree to these terms. If you do not agree, please do not use the app.
1. What HULA is
HULA is a mobile app that lets you photograph objects in your home and receive an estimated second-hand value for them.
HULA is offered by José Antonio Bao Barceló, Alberto Jaén and Ignacio García-Fontecha Zúñiga, three private individuals, as a free service in a test phase. It is not operated by a company.
We also intend to add features that let you exchange, swap or pass on those objects to other users. Those features are not available yet. When they are, taking part will be your choice — nothing you own becomes visible to anyone else unless you offer it.
2. Estimates are estimates
This is the part that matters most, so please read it.
The values HULA shows are automated estimates, not appraisals. They are generated by an AI system from a photograph and from public marketplace data. They can be wrong, sometimes substantially. Two scans of the same object may return different numbers.
Do not rely on a HULA estimate as the basis for a sale, a purchase, an insurance claim, a tax filing, a legal proceeding or any other decision with financial consequences. It is a starting point for your own judgement, nothing more. We give no warranty that any estimate is accurate, current or achievable in any market.
3. Your account
You can use HULA as a guest or with an account. You must be at least 16 years old. You are responsible for keeping your login credentials secure and for activity under your account.
You may delete your account at any time from within the app. Deleting your account deletes your data.
4. Your content, and what you may photograph
You keep ownership of the photos you take. By using HULA you grant us a limited licence to store, process and transmit those photos to our service providers for the purpose of providing the service to you — identifying the object, estimating its value, and, if you choose to offer an object for exchange, showing it to the users you are exchanging with. That licence ends when you delete the content or your account.
We do not use your photos to train AI models, and we do not license them to anyone else.
You must not upload:
- photographs of other people without their consent,
- content that is illegal, or that infringes anyone else's rights,
- content depicting or intended to facilitate criminal activity,
- anything that is not, in substance, a photograph of an object you are valuing.
We may remove content and suspend accounts that breach these rules.
5. Acceptable use
Do not attempt to reverse-engineer, scrape, overload or circumvent usage limits of the service, and do not use it to build a competing dataset or product. Automated or bulk access is not permitted.
Usage quotas apply and may change. Guest accounts have lower limits than registered accounts.
6. Price and availability
HULA is currently free to use. We may introduce paid features in the future; if we do, we will make that clear before you are charged for anything.
HULA is in a test phase. We may modify, suspend or discontinue the service, in whole or in part, at any time. We will give reasonable notice where we can.
7. No warranty
The service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, express or implied, including as to accuracy, fitness for a particular purpose and uninterrupted availability.
8. Limitation of liability
To the fullest extent permitted by Swiss law, we are not liable for indirect, incidental or consequential damages, or for any loss arising from your reliance on an estimate produced by the app. Nothing in these terms excludes liability that cannot be excluded by law, including for intent or gross negligence.
9. Changes to these terms
We may update these terms. Material changes will be announced in the app before they take effect. Continuing to use HULA after that means you accept the new terms.
10. Governing law and jurisdiction
These terms are governed by Swiss law. The place of jurisdiction is Zürich, Switzerland, subject to any mandatory place of jurisdiction for consumers.
